we're now learning more about why Glynn County police never arrested either of the two men involved in the shooting death of 25 year old Ahmad armory this ladder that I'm holding in my hand right here written by district attorney George barn he'll insist there is no probable cause to arrest either Travis McMichael who fired the deadly shots or his father Gregg McMichael Gregg is the one who suggested chasing after our burry when he saw the 25 year old running in Brunswick neighborhood district attorney Barney Hill states in this letter to a captain with the Glen County Police Department that both men are protected under Georgia's citizen's arrest law he writes it appears the father and son quote were following in hot pursuit of a burglary suspect with solid first hand probable cause in their neighborhood and asking or telling him to stop Barnhill goes on to write it appears their intent was to stop and hold this criminal suspect until law enforcement arrived news 4 jacks anchor genoise spoke with the Brunswick criminal defense attorney who says that is not his interpretation of the citizen's arrest law or the facts as we know them Paige pate has been practicing criminal defense for 25 years in the state of Georgia he says the reason the citizens arrest law was created was to allow retailers to apprehend someone that they think may be shoplifting he says he can't think of any legitimate legal reason why that law would be cited though in this case to exonerate the men involved in a mod armories shooting death what's critical about Georgia's law although you are allowed to detain someone as a citizen if you think they've committed a crime you cannot use excessive force so even if there was a crime committed and he was trying to hold on to mr.
armory to wait for the police you cannot then escalate it as I think happened in this case Paige pate is referring to this video which shows two men both armed in a pickup truck parked and waiting for Ahmad Arbor as he ran down scintilla Drive what's just as puzzling to pate he says his details of the police report taken the day the 25 year old was shot and killed Gregg McMichael told a Glenn County police officer that there had been several break-ins in the neighborhood but it does not say he actually witnessed a crime that day which is a requirement under the citizen's arrest law instead the report says McMichael was in his front yard and saw the suspect from the break-ins hauling blank down cedilla drive he believed that suspect was Ahmad Arbor II and nowhere in the report does McMichael tell the officer that he and his son were trying to make a citizen's arrest citizen's arrest was not what mr.
McMichael was saying at the time he was saying that his son was acting in self-defense the district attorney in Waycross as part of his justification not to charge these people or to recommend that they be charged came up with a citizen's arrest offense george Barnhill would not comment when the i-team called him about his letter to Glenn County police in that letter he also says he believes Travis McMichael was defending himself when he shot our burry pate disagrees with that interpretation of the video I don't think this is a good self-defense case for mr.
McMichael I mean number one you see armory running down the street he is not approaching the McMichaels he's not threatening them he doesn't present any sort of threat whatsoever they are chasing him and then at the point where Travis McMichael has the gun and is pointing it at Aubrey it is totally reasonable and justified for mr.
